User Agreement (Draft – TÜRSAB Compliant)

1. Parties

This agreement is concluded between Best Time Travel (hereinafter referred to as “Agency”) and the user who benefits from services through the website or mobile application (hereinafter referred to as “Consumer”).

2. Subject

The subject of this agreement is to determine the rights and obligations of the Consumer regarding the use of tour, package tour, and travel services provided by the Agency in accordance with Law No. 1618 on Travel Agencies and the Association of Travel Agencies and related regulations.

3. Services

• The Agency, as a member of TÜRSAB, provides services in compliance with tourism legislation.

• Package tour contracts are prepared in accordance with the Package Tour Contracts Regulation.

• For distance sales, the provisions of the Distance Sales Regulation apply.

4. Consumer Obligations

• The Consumer undertakes that the information provided during reservation is accurate and up to date.

• The Consumer agrees to comply with the payment terms specified during booking.

• The Consumer agrees to follow safety instructions during the tour.

5. Agency Obligations

• The Agency undertakes to provide services in accordance with legislation.

• The Agency provides the Consumer with written information regarding the tour program, price, cancellation, and refund conditions.

• The Agency processes and stores personal data in compliance with the Personal Data Protection Law (KVKK).

6. Cancellation and Refund Conditions

• If the Consumer cancels the package tour at least 30 days before the start date, the full amount paid will be refunded.

• For cancellations made less than 30 days before the start date, the provisions of the Package Tour Contracts Regulation apply.

• In case of force majeure (weather conditions, natural disasters, etc.), the tour may be canceled and the fee refunded.

7. Privacy and Personal Data

• The Consumer’s personal data is processed only for the purpose of providing services.

• Data is not shared with third parties, except in cases of legal obligation or explicit consent.

• The Consumer has the right to access, correct, and request deletion of their data under the Personal Data Protection Law.

8. Limitation of Liability

• The Agency informs the Consumer about the risks inherent in rafting and other outdoor activities.

• The Consumer is obliged to comply with safety instructions provided.

• The Agency is not responsible for damages arising from failure to comply with instructions.

9. Dispute Resolution

• In case of disputes arising from this agreement, Antalya Courts and Enforcement Offices are authorized.

• The Consumer has the right to apply to the Consumer Arbitration Committee under Law No. 6502 on Consumer Protection.

10. Enforcement

By using the website, the Consumer is deemed to have accepted all provisions of this agreement.
